Ticker Lab — Terms of Service

Please read these Terms in full. By creating an account or using the Service, you agree to be bound by them.

1. Definitions

  • "Platform" / "Service" means ticker-lab.com and all sub-domains, products, and services offered thereunder (currently: ApexQQuant, EOD Analyzer, Intraday Analyzer, Market Pulse).
  • "the Operator", "we", "us" means Satyabrata Mishra, the entity that owns and operates the Platform.
  • "User", "you" means any individual who creates an account or otherwise uses the Platform.
  • "Subscription" means a paid plan granting access to specified Platform features.
  • "Free Tier" means access to limited Platform features without payment.

2. Eligibility

You must be at least 18 years old and legally competent under Indian law to enter into binding contracts. By creating an account, you represent and warrant that you meet these requirements. The Service is intended for use by individuals located in India.

3. Account creation

You agree to provide accurate, current, and complete information at signup. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised access.

You may create only one account per individual. The Operator reserves the right to suspend duplicate accounts or accounts created with false information.

4. Permitted use

You may use the Platform for personal, non-commercial purposes consistent with these Terms. You may NOT:

  • Scrape, crawl, or systematically extract data from the Platform via automated means without our written consent
  • Reverse-engineer, decompile, or disassemble any part of the Platform
  • Resell, redistribute, or commercially exploit the Platform's outputs without our written consent
  • Use the Platform for any unlawful purpose, including violation of securities laws, market manipulation, fraud, or money laundering
  • Attempt to gain unauthorised access to other users' accounts or to Platform infrastructure
  • Interfere with Platform operation (denial-of-service attacks, malware injection, exploitation of vulnerabilities)
  • Misrepresent your identity or affiliation

5. Subscription, billing, and refunds

5.1. Pricing. Subscription tiers, prices, and feature lists are published at the Platform's pricing page. Prices are in Indian Rupees (INR) and include applicable Goods and Services Tax at 18%, unless stated otherwise.

5.2. No auto-renewal. A Subscription is a one-time payment for a fixed access period; it does not auto-renew and no recurring debit or e-mandate is set up. When a paid period ends, paid access lapses unless you make a new payment for a further period.

5.3. Payment processor. Payments are processed by Cashfree Payments. Card details are handled by Cashfree under PCI-DSS standards; the Operator does not store card information.

5.4. Refunds. All payments are final and non-refundable once charged, save for genuine billing errors (e.g. a duplicate or incorrect charge) and where required by law. Refunds are governed by our Refund Policy at /legal/refund.

5.5. Price changes. The Operator reserves the right to modify pricing at any time. A price change applies only to new purchases made after it takes effect; it does not affect access you have already paid for.

6. Intellectual property

6.1. All Platform content — including but not limited to source code, calculations, indicator algorithms, design, layouts, logos, and documentation — is owned by the Operator or its licensors and protected by Indian and international copyright, trademark, and other intellectual property laws.

6.2. You retain ownership of any data you submit (for example, notes, configurations, screener queries you save). By submitting such data, you grant the Operator a limited, non-exclusive, royalty-free licence to use it solely for the purpose of providing Platform services to you.

6.3. You may not use Ticker Lab's name, logo, or trademarks without our prior written consent.

7. Disclaimers and limitation of liability

7.1. The Platform is provided on an "as is" and "as available" basis. The Operator disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7.2. As detailed in our Disclaimer at /legal/disclaimer, the Platform does NOT provide investment advice, financial advice, or trading recommendations. The Operator is not registered with SEBI as an Investment Adviser or Research Analyst. You bear sole responsibility for all financial decisions you make.

7.3. To the maximum extent permitted by law, the Operator's aggregate liability arising from or related to these Terms or your use of the Platform is limited to the amount you have paid to the Operator in the twelve (12) months preceding the claim, or ₹10,000, whichever is lower.

7.4. Where applicable law does not permit the exclusion or limitation of certain warranties or liabilities, the above limitations apply only to the extent permitted by that law.

8. Indemnification

You agree to indemnify and hold harmless the Operator, its owners, employees, agents, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or third-party right
  • Your use of the Platform in any manner not permitted hereunder

9. Termination

9.1. By you: You may terminate your account at any time through account settings or by contacting Support. Because access is sold as a one-time payment for a fixed period, termination does not entitle you to a refund of any payment already made (see the Refund Policy).

9.2. By the Operator: The Operator may suspend or terminate your account immediately for:

  • Material breach of these Terms
  • Engagement in illegal activity, market manipulation, or fraud
  • Non-payment of subscription fees
  • Extended inactivity (≥ 24 months for Free Tier accounts)
  • Operator decision to discontinue the Service, with reasonable notice

9.3. Upon termination, your right to access the Platform ceases. Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution) shall survive.

10. Modifications to these Terms

The Operator may update these Terms from time to time. Material changes will be notified by email to the address on file and by in-app notification at least 15 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

11. Governing law and dispute resolution

11.1. These Terms are governed by and construed in accordance with the laws of India.

11.2. Any dispute arising under or relating to these Terms shall first be addressed through good-faith negotiation between the parties for a period of 30 days.

11.3. If negotiation fails, disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted in Kollam, Kerala in the English language by a sole arbitrator appointed by mutual agreement.

11.4. The courts of Kollam, Kerala shall have exclusive jurisdiction for any matters not subject to arbitration.

13. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

14. Entire agreement

These Terms, together with the Privacy Policy (/legal/privacy), Disclaimer (/legal/disclaimer), and Refund Policy (/legal/refund), constitute the entire agreement between you and the Operator regarding the Platform.
